Agreement of Purchase and Sale executed by Purchaser Shaik Khaja Pasha for Lot 5, Plan 40M-2767 in Pickering, Ontario (Model: The Jasmine - 302A) at a purchase price of $873,990.00. First deposit of $10,000.00 submitted via credit card. Includes $5,000.00 in Design Centre upgrades (inclusive of taxes) included in the purchase price.

Agreement formally accepted by Vendor Sundial Homes (White Sun 1) Limited. Amendment to Agreement signed and accepted to cap specific closing adjustments (Water & Hydro Meters at $0, MTO at $3,428.00, Region Transit at $918.40, Community Levy at $645.00, Law Society Fee at $65.00, Internet/Delivery/Survey at $789.92, Driveway Paving at $1,250.00, Development Charges at $5,000.00, plus applicable HST).

Purchaser must deliver written confirmation of income, asset/liability statements, a firm mortgage commitment, and credit check authorization to the Vendor within 10 business days of acceptance.

Second deposit installment of $10,000.00 due via credit card.

Expiration of the Vendor’s 15-business-day review period following receipt of financial information to confirm satisfaction with Purchaser's creditworthiness.

Third deposit installment of $15,000.00 due via credit card.

Fourth deposit installment of $15,000.00 due via credit card.

Fifth deposit installment of $20,000.00 due via credit card.

Sixth and final deposit installment of $20,000.00 due via credit card, bringing total deposits paid to $90,000.00.

Target date for commencement of construction of foundation components. The Vendor must provide written notice to the Purchaser within 10 days after construction actually commences.

Latest date for the Vendor to give written notice (at least 90 days prior to First Tentative Closing) to set a Second Tentative Closing Date. If notice is not provided by this date, First Tentative Closing automatically becomes the Firm Closing Date.

Target closing date established in Statement of Critical Dates on which Vendor anticipates home will be completed and ready for move-in.

Latest date for the Vendor to give written notice (at least 90 days prior to Second Tentative Closing Date) to set a Firm Closing Date if a Second Tentative Closing Date was set.

Latest permissible Second Tentative Closing Date (up to 120 days after First Tentative Closing Date).

Latest permissible Firm Closing Date (up to 120 days after Second Tentative Closing Date).

Purchaser's solicitor must examine title and deliver any valid written objections/requisitions to Vendor's solicitor. Purchaser must also confirm exact manner in which title is to be taken.

Purchaser (or appointed designate) meets Vendor representative to complete the Pre-Delivery Inspection, record any incomplete items or deficiencies on Tarion Certificate of Completion and Possession (CCP) and PDI Form, and review operation of home systems.

Maximum permissible closing date under Tarion Delayed Closing Warranty (365 days after earlier of Second Tentative or Firm Closing Date).

End of 30-day period following Outside Closing Date. If closing has not occurred by Outside Closing Date, Purchaser may terminate transaction in writing for a full refund of monies paid plus interest and delayed closing compensation up to $7,500.00.
